Background checks
Your rights under the FCRA
Last updated July 9, 2026.
As part of membership vetting, First Class obtains a background check on applicants through a background-screening company. The Fair Credit Reporting Act (FCRA) gives you specific rights in that process, summarized below.
Before you're screened
We disclose that a background check may be requested and obtain your written authorization before any check is initiated. This is separate from our general Terms of Service and Privacy Policy consent.
If a report may affect your application
Before we make any final decision based on your background check, we will send you:
- A copy of the background check report used in the decision.
- A summary of your rights under the FCRA, prepared by the Consumer Financial Protection Bureau (CFPB).
- A reasonable period of time — at least five business days — to review the report and dispute anything you believe is inaccurate before we finalize any decision.
Your right to dispute
If you believe any information in your background check report is inaccurate or incomplete, you have the right to dispute it directly with the background-screening company that prepared it. They must investigate your dispute and correct any confirmed errors. Contact information for our screening provider is included in the notice you receive.
If a final decision is made
If, after that period, we proceed with a decision based in part on your background check, we will send you a final notice. That notice will confirm that FCM Solutions LLC — not the background- screening company — made the decision, and will restate your right to obtain a free copy of your report and dispute its accuracy.
